QUESTION

Do I have grounds for a defamation case?

Asked on Apr 25th, 2013 on Civil Litigation - Tennessee
More details to this question:
My ex-girlfriend charged me with stalking. We go to same school. She accused me of slashing tires, breaking and entering, waiting outside her classes, waiting in the one parking garage, waiting by the gym. I have been cleared on all charges and was curious about pursuing a defamation case and if it is worth my time.

Generally, statements made in a court proceeding are protected.  Also, you must show that you were economically harmed, other than defending the criminal action which was brought by the state.  Finally, the standard of proof is less in a civil case so a judge or jury could find for her even if you won the criminal case as a defendant.
