Do I have or can do anything to them for not giving back the check?

More details to this question:
My dad is trying to get her roof fixed and they had him sign a insurance check to them before any work being started to get supplies they said with NO estimate saying a date to start and price not anything. Now they will not give back the check.

You can sue them to get the funds back.

Your dad was foolish for hiring someone without getting a written estimate. go to the police. That is criminal fraud. Prosecute them. Do it NOW.

Why should they. If you agreed to pay them, and you paid them they have to perform. They dont have to give check back unless they refuse to perform. If they do sue the rascals

If you are cancelling the job you can sue them to get the money back because they didnt earn it.

Call the insurance company and have them put a stop payment on that check.
