QUESTION
Do I have to provide documents without written request?
Asked on Sep 10th, 2012 on Civil Litigation - New Jersey
More details to this question:
I am a defendant in a civil case and the plaintiff's attorney's office just called asking me to provide documentation to them for pick up this afternoon. I never received anything in writing from this attorney's office requesting this documents and I explained to the plaintiffs attorney that I had already previously provided that documentation to their client (plaintiff). Do I have to produce these documents if they weren't asked for in writing?

No - you do not have to supply any additional information without a written request. The attorney needs to serve you with a Notice to Produce, and give you sufficient time to comply and provide the documents. the attorney will review the documents, and if the attorney feels that you either produce the right documents, or not enough documents, they will have an opportunity to file something else and cause you to have to produce the documents, or explain why you cannot.
