QUESTION

Do I name a corporate officer as a codefendant in small claims court?

Asked on Aug 11th, 2014 on Civil Litigation - Colorado
More details to this question:
I took my wedding band to a local jeweler for repair. Long story short, he destroyed the center stone and severely damaged the mounting. Estimated damage $4500. Unknown to me when I left the ring, the business had decided to go out of business. They have since closed their doors. I named the corporation as a defendant in a small claims action c/o the president as the business had closed. Should I have filed the suit as ABC Company AND John Doe? Can you sue an officer of the corporation individually? Thank you.

The answer is yes it is likely that you should have named the Pres individually.  This depends on the company structure as to whether or not he has personal liability.    Good Luck,
