QUESTION

Do I still have to pay the Macy's fine?

Asked on Jun 19th, 2013 on Civil Litigation - New York
More details to this question:
I was involved in an incident last month regarding Macy's for larceny in mercantile establishments. I was given a fine but i had to go to court as well. I went to court and the judge granted me an ACD & 1 day of community service , i also completed a youth program regarding my case. I attend community service on the 27th. The lawyer that was given to me at the court told me i don't have to pay the Macy's fine. The fine is $419.00. I have recieved 3 letters from Macys saying if i dont pay soon , they can send out a warrant for me. Do i still have to pay the Macy's fine? Macy's is forcing me to pay, i'm a full time student & still in school. I have no idea on what to do. Please help me.

I recommend to my clients not to pay.  It is a shake down.  The law they purport to sue on allows them to seek civil damages only where the property is not recovered.  However, in all of these case the property is recovered.
