I guess it depends on the extent of disability. If they can make "reasonable" accommodations, then they must take the child.

It depends on what you mean by "refuse". School Districts must accommodate disabled kids. They cannot refuse to provide them with an education. They can provide alternate classes rather than letting them go to regular classes.

Don't know the answer to your question but don't all systems have provisions for disabled have you researched it? checked the Amertcan With Disabilities Act?
