A Louisiana judge has denied my participation in court hearings via videoconferencing, stating it was up to her discretion. I am the defendant and live 8 hours from the court. I am 71 yrs old and my disabilities prevent me from traveling that far. The court already has Zoom capability and utilized it during the pandemic. Is it at the judge's discretion to deny me access? Who can I contact to enforce my disability right to access the court via Zoom?
There is no absolute right to appear by video, instead of in person, when subpoenaed to attend a trial on the merits in Louisiana. You should talk to your attorney. If you do not have an attorney, you should probably find one.
You should also be making contingency plans to be in court, in person, on the trial date.
