Asked on Oct 23rd, 2017 on Civil Litigation - Wisconsin
More details to this question:
What happens if my wife gave recordings of us to her friend to hold onto. Can my wife use them in TRO hearing if she didn't have them in her possession the whole time. Would that be considered a break in chain of custody or anything like that??? Please help me out. Thanks

There is no provision under s. 885.365(1) to deal with the "chain of custody," of wiretap information. The issue is irrelevant to whether it is admissible or not in a Wisconsin court room.
