More details to this question:
Put down a $2000 deposit for an above ground pool, that was supposed to be delivered back in end of March. Sales person keeps delaying several times, now it's not supposed to arrive until end of August. We have had the electrician, and installer on hold waiting for pool delivery since early in the year. Sales person cannot guarantee end of August date, either. The delivery date at this time ,seems to be open ended. Current sales contract is very lopsided in sales company favor. We would like to just get our deposit back to see if we can find an alternative pool company. Just had a conversation with the sales person, he orally agreed to return deposit, but just want to make sure what my options are if he then changes his mind.
The written contract is binding. We would have to review the contract. Normally the contract states that oral discussions are not binding. Please call to discuss. Ed Dimon, Esq. 732-797-1600 ext 235
