I am a senior and needed to complete only one more semester to graduate. I have two professors for this particular course. Professor A gave me an unfair adjusted curve grade by removing ten questions from our test. However, I learned from some of my classmates that she had added ten points to their scores instead. According to this information, Professor A did something to help other students with their grades, but I received no such benefit. Unfortunately, Professor A had left after giving the first test so Professor B took over the rest of the semester. So here is the problem, Professor A referred everything to Professor B and stated she can't remember which ten questions she had removed from the test. How could this be? It takes a lot of effort to decide which questions are valid for removal. Anyhow, I did attempt the formal written grade appeal already through the school but was denied. As a result, the VP stated "the Faculty Council looked at the grades and notes provided by Professor B, did not believe evidence existed of any wrongdoing by Professor A or Professor B." Please note that I didn't get the opportunity to appear at the hearing so I couldn't ask any questions. I'm only .8 away from passing so if Professor A did the curving correctly I would have passed. But under the circumstances and from previous interaction with Professor A, I have ground to believe that she purposely did not curve my test grade. This is utmost important to me because I'm being expelled from the program for the grade adjustment unfairness. Therefore, I want to sue the school and faculty for discrimination toward me, grade adjustment, and any compensation for my lost time and money.
As a general matter, the judicial system does not involve itself in second-guessing academic determinations. In other words, in nearly all cases such as yours, the judicial system will defer to the academic determination of your grade. There is a great deal of jurisprudence on this point. Since you have already exercised your internal right of appeal within the school, the courts are overwhelmingly likely to dismiss any claim based on these facts.
