QUESTION

HOA distress

Asked on May 27th, 2015 on Litigation - New Jersey
More details to this question:
I own a townhouse, been in this association for 3 years now, hoa payments are being made on time. In terms of issues reported by me to the association, i have received nothing but excuses , this has led me to mental distress. I have everything in writing on the communication i've been having with the condo management. I'm fed up with their responses and want to have monetary action against them for caused distress and pending issues. How can we proceed with this case.

We have significant experience with homeowner associations given our location in Ocean County. Ocean  County may have the largest number of  Homeowner associations.  We would need to review the association bylaws.  We would need to make sure that your written demands were in compliance with the bylaws. We would need to make sure that your demands were reasonable.  We would negotiate on your behalf to have the reasonable demands implemented. It would not be possible to obtain damages for mental distress unless the actions were gross negligence and intentional. Please call to discuss.
