QUESTION

How can a person living overseas sue me?

Asked on Oct 05th, 2012 on Civil Litigation - New York
More details to this question:
I am a landlord who had a tenant who came from overseas. She left some damage when she moved back home and I deducted a portion of her security deposit. She asked her US friends to dispute the damages with me, and they claim that they will take me to court. I am not worried about presenting the facts to a judge, but I am just wondering what is the process to go to court with an overseas person. Can she give power of attorney to her US friends to take me to court? How can I argue with her friends who don't have all the facts? Can she "attend" court via webcam if her friends file all the paperwork for her? Can she hire an attorney in US to present her and never show up in court?

There are so many variables here that it is impossible to answer all of your questions. That being said, ordinarily, neither a power of attorney nor a webcam, will be allowed. She certainly can file  a lawsuit through a US attorney. You may wish to consult an attorney or await the service of lawsuit papers.
