How can I phrase a question without it being blackmail?

More details to this question:
I have legal grounds to file a lawsuit against someone but I would prefer to settle the issue without taking them to court. How can I ask if they are willing to do that, and let them know that if they don''t, I am considering taking legal action without it being considered blackmail?

That is not blackmail if you have a colorable claim.
