QUESTION

How do I recover expenses for my damaged car

Asked on Feb 13th, 2018 on Civil Litigation - Florida
More details to this question:
On Sept 30th, L &M Movers transported furniture etc and my car on a carrier from St. Louis, Mo to St Augustine, Fl. On OCt 2nd The mover arrived in St. Augustine and explained that my car was hit in the rear as he was trying to move over to the left lane in Macon Ga. Prior to signing the contract, the mover, Chris Merriweather informed me that I didn't need additional insurance for my car, it was provided. Neither the mover or the party insurance company will not pay. How can I be compensated for expenses paid out of my pocket? Also, I found a home and getting ready to move. What about potential damages? What state do I need to file legal action?

If there was no insurance on your car to cover the issue from YOU, then you likely have a CARMACK Amendment case which is a Federal  DOT rule that addresses interstate mover liabilty, disclosures and the like. These can be expensive and difficult cases to litigate if the mover crossed the T's and dotted the I's so the expense of such litigation will need to be weighed against the value of the repairs.
