I had a flat tire and put my hazards on. I was then pulled over by a sherrifs deputy. I explained my situation and then was asked to do a field sobriety. I asked for a breathalyzer bcuz i felt it would be a quicker way to prove and or calm any suspicion and wasnt allowed to blow because the officer didnt have a unit with her. I asked her to radio another officer and was denied. I was arrested, taken to county breathalyzed and was not found to be drunk. This made me angry. I was then asked for more test and ultimatley had to bond out of jail. I was SOR until court where all my charges were dropped by the prosecutor. I was able to get back my bond $, but my car was inpounded and i missed work and id like to seek restitution and more from palm beach county for the inconvienence and hardships this officers actions have caused me. I have all my documents to prove my case. And my license has not been returned to me. Its been almost two weeks since i was in court and my case was heard. No lic
There is no case here. First, there is definately probable cause to stop you for driving on a flat tire and its illegal to operate a vehicle on the road with flashing harazard lights. That you sound like you were demanding and aggresive with the officer in regard to a brethalyzer and refused and FST likely created PC that you were high on something else and trying to distract by demanding an alcohol test you knew you would pass, hence the reasons for the "other tests" which presumably you took and also passed. The issue with your license may be separate as there may still be an issue about your refusal to take the FST or possibly the other other tests if you refused them also.
