I am suing someone in small claims

More details to this question:
The Dept of Health is going to take a year or two before their legal dept comes up with a decision, and statute of limitations/. so if I lose can I ever sue the same person again IF they for instance (since she was NOT licensed when she worked on me I do not believe) and if they finally finish the case and that comes out I would wish to resue if I have lost, but I have heard once you as the plaintiff sues in small claims if you lose you cannot sue the person again EVEN if you have new evidence?

What you heard is true. If you sue someone in any court and lose, your only remedy is an appeal. You cannot sue someone again for the same matter even if you have new evidence.
