QUESTION

I let a neighbor use my walker & she was evicted. How do I get my walker back

Asked on Jul 08th, 2017 on Civil Litigation - Wisconsin
More details to this question:
My neighbor needed a walker to use because she left her walker at the UW Hospital. She was allowed t use mine until she got hers from the hospital. Her niece came and got her upon the eviction. She left without asking if she could take my walker. I texted her niece who she is staying with to return the walker & they refused because they had no gas. The neighbor knew she was being evicted and I made it clear the walker was not to leave the place. I am disabled that is why I have a walker. I need my walker because there are times I need to use it myself. I live in Dodgeville, WI which is Iowa county. What can I do to get my walker back? I worry it will not be in the same condition as it was when it left. It may sound petty, but she knew it was only temporary until she got hers.

File a small claims lawsuit; you will need to weigh the cost of replacing the walker on your own against the cost of buying a small claims summons, paying for process of service, and the hassle  of going to court, perhaps several times to deal with your former neighbor. Most likely, they will argue that you gave them the walker as a gift.
