QUESTION

If I missed the appeal timeline do I have any options?

Asked on Aug 22nd, 2011 on Civil Litigation - Virginia
More details to this question:
Plaintiffs filed a complaint. I countersued. We appeared in court and cases were dismissed. I left on military commitments. The plaintiff''s appealed. I was not notified. I have missed the appeal time frame. Can I file a counter claim? This case is in VA and I am in a different state due to the military. The case was in the general district court but has been appealed to the circuit court. The clerk states there is no countersuit form for civil court. She also told me I have no options. I hope this isn''t correct. I appreciate any advice.

If you were on active duty deployment over seas you may still have options. Similarly, if you did not receive notice of the appeal you may have options. You probably want to contact a local attorney as soon as possible.   Robert R. Musick ThompsonMcMullan, P.C. Richmond, VA 804.649.7545
