I was assaulted in August by a homeless man, who i later found out had open warrants against him in nyc, and was also wanted in connection with a similar assault in another town. I also believe he was in custody previously before my assault. I also believe he was part of nyc's program to give housing to homeless people in suburban communities, and think he should have been background checked before hand.
So sorry to hear what happened to you. Unfortunately the City of New York has what's called "qualified immunity" for these types of decisions and, generally speaking, is not responsible for bad decision making. In other words, the City's decision not to perform a background check on this homeless man before placing him in your community is not actionable absent some special relationship between you and the City.
