QUESTION

In a Multistate Class Action, does each states' representative/named plaintiff have to testify?

Asked on Nov 18th, 2014 on Civil Litigation - California
More details to this question:
In a MDL consumer, class action suit in which the complaint names 12 plaintiffs from different states (representatives), do each of these representatives have to testify at trial, or can one testify for the entire class? That is, will a named plaintiff who was certified to represent people of NY, also represent the other named plaintiffs from other states and their constituents, or is each plaintiff on the complaint the lawyers submitted required to testify at the trial

There is no requirement that a plaintiff testify at trial, in a class action or any other suit.  It is often  the only way to present sufficient evidence, however, and advisable from a tactical standpoint.  Also, although any member of the class, named or not, may be deposed, it is quite likely that all named representatives will be deposed.
