QUESTION

in indiana does an LLC have to be represented by an attorney

Asked on Dec 12th, 2012 on Civil Litigation - Indiana
More details to this question:
I sued an LLC business in civil court and won my requested judgment. The business has filed an appeal to the ruling. In Indiana does the business being an LLC have to be represented by an attorney, and if they do may I request the court for a dismissal if they are not represented by one and ask the court to uphold the lower court ruling ? And since the awarded judgment is small I plan to represent myself.

Generally speaking, an LLC must be represented by counsel. Failure to be represented will not generally be permitted to be raised as a ground for dismissal unless the entity has been duly warned and had an opportunity to obtain counsel.
