QUESTION

in Nashville, who makes the first settlement offer, plaintiff or defendant?

More details to this question:
I am not from Nashville, but find myself involved in a lawsuit there. In Miami, where I am from, settlement offers are made by the Defendant first. But, we are being told that in Nashville, the Plaintiff make the first settlement offer -- which makes very little sense to me. Is this true and, if so, how does that make sense or work?

There is no rule that says that either party is required to make the first offer. Either party can make the first offer.
