Is it illegal to give someone an ultimatum?

More details to this question:
Long story - short: a mechanic has had my car for about 8 weeks and isn't fixing it. He's already been payed (I have a receipt). He almost never answers his phone and if he does he always says the car "will be ready tomorrow." I want to tell him I want my car ready by a specific date or my money back and if he doesn't do either, then I'm going to take him to court. Can I say that? Or will I just get into legal trouble if I do?

I don't know if it will work or if you will just make the mechanic angry, but there's nothing illegal about what you want to do.
