QUESTION

Is there an attorney in FL who will handle a malicious prosecution matter?

Asked on Oct 03rd, 2016 on Civil Litigation - Florida
More details to this question:
I was named in a lawsuit as a co defendant with my former employer, accused of wrongful death for an incident that happened long after I stopped working for them. Both the plaintiff's attorney & defense attorney assigned by the insurance company were notified that they had the wrong person named on the lawsuit. Neither would file the appropriate motion with the court to dismiss the case against me. The reason is because the case is far more consequential with the correct people named. My best guess is that they hope to get to a settlement before any of it goes to court & they can keep some of the details out of court that would hurt them. Meanwhile - I work in an industry where executives live or starve based on their background check. This case is now a part of my permanent certiphi background check (required in my industry) and has caused irreparable damage to my future employability & earnings. Looking for an attorney who will file a malicious prosecution suit on my behalf.

You are likely barking up the wrong tree. It is no one's responsbility other than your own to defend your interests in a law suit. Simply throwing out the "notice" of "It waddn't me!" like bad Shaggy video is not the proper means to address this. If you are the wrong party, and named individually, you retain legal counsel, make appropriate motions or raise defenses, and ask the court to dismiss you as a party in proper fashion. IF you expect the Plainitff will refuse, then your lawyer can take steps to "set them up" so the speak for sanctions or later your malicious prosecution type claims. YOu can't file an MP case while you are still an active party to the action.
