More details to this question:
We bought a house in Ca. and the seller failed to disclose a defect in the pool. They moved to Co., thus cannot use SCC in Ca. to collect for the repair cost to the pool. Must use Co. court but will the court accept me as plaintiff via telephone instead of appearing in court?

You can sue in California Superior Court in the county where the house is located.  You are not required to sue in Colorado where the defendants live.
