Mold lawsuit?

More details to this question:
I have been complaining about leaking water since the begining of this year, and even complained about headaches in FEB. I have discovered that I cannot test the apt for mold myself and the landlord has been negligent. (We have called at least 6 times, no response.) I have discovered visable black mold spots but cannot test since I do not own the apartment. My quality of life has been effected, we cannot reside in the home due to the symptoms of sickness we begin to feel after just one hour in the aprtment, and she is still trying to charge us rent- mind you, she has had absolutely no contact with us regarding our concerns or issues. I believe we want to sue, just need to know if we have a case.

From the facts that you present you very likely have a good case.  We'll need a doctor to link your health issues to the mold and a mold report.  I've never had a problem getting a mold report for a tenant before, I don't understand why you are having such a problem.  But, you should get this report before your relinquish possession.   Good Luck,   Don Eby
