Hello. I received a summons at my home for my boyfriend (the defendant)who is being sued. He is currently in jail, and will not be out in time of the court date. I have contacted the courts and was in formed, according to their records the defendant has not been served. My questions are: 1. Can the plaintiff consider giving me the summons paper work as serving the defendant? What should I do to ensure the plaintiff judgment is not falsely granted because the defendant is unable to appear? Do I contact the plaintiff? Thanks for your time and attention in this matter!!
Yes, he has most likely been properly served. Substituted service is upon an adult at the home and then mailed to the residence. He will have to hire an attorney to file a response and appear for him.
