My ex smashed my car with a baseball bat but...

Last night at 12:15 am my ex (and mother of my daughter) and her new boyfriend took a baseball bat and smashed all the windows out of my car And stabbed all of my tires. I caught her in the act and so did 6 of my neighbors. The boyfriend was so high he almost cut his whole finger off. When I called the cops they said to get an estimate for the damages and they will charge her for it. My question is if her name is on the title along with mine, will she get away with this if we go to court? I have insurance on the car in my name, she doesn't. She won't sign the title over to me because she wants to "make money" if I sell it. I have messages where she admits that's the only reason she won't sign it over.

If the police are willing to pursue charges, that's the best bet for you.  If she's convicted, she'll be required to make restitution.  Boyfriend certainly didn't have the right to damage your car.  He can be charged too.  Why wasn't the car ownership issue resolved in your divorce?  You might also consider filing for a protection from abuse order against the ex to keep her away from you.
