Neighbor with pool refusing to drain

More details to this question:
Our neighbor has an inground pool behind us uncovered with water raising daily a broken fence from storm Sandy he refuses to speak with us, if his pool overflows into our yard and causes flooding in our basement with damages can we sue him?

Probably not. Any resulting flooding would be due to a natural disaster and not to the negligence or intentional act of the neighbor.
