Partition lawsuit

More details to this question:
Although my husband left no will, I'm told I inherited his half of a two-family house after he died 14 years ago. The other half belongs to his sister (now in a nursing home). They had inherited the property from their parents. My question: Assuming a partitions lawsuit is successful for the plaintiff, does the lawyer's fee usually include "one-third of all monies received"? Thank you.
