QUESTION

Personal injury on property own jointly by four siblings

Asked on Jul 07th, 2013 on Litigation - Kentucky
More details to this question:
I have two brothers and a sister and we all jointly own two farms in KY. One question we have is this: if one of us is being sued in a personal injury lawsuit, and loses, will we have to sell the farms in order for the one to use the money to pay the injured person? Fortunately this is a hypothetical question...at this time!

I'm not sure if I fully understand your question, but I believe the answer would be a hypothetical no.   Your insurance policy should cover claims for personal injuries that occur on the property and thus, you should have insurance coverage for that.  You don't always have to file a lawsuit so I would recommend trying to file a claim with your insurance company to request funds to cover for the personal injury that occurred on the farm.  If you are stating that one sibling is being sued for personal injury and it is not related on an injury that occurred on the farm, or related to the farm at all, and the sibling losses the case - it depends I guess.  Would need to know if there is any other possible insurance coverage that could cover the sibling for the losses and/or injury the sibling caused.  If the sibling losses the case and the Judge/Jury orders monetary payments, then the Court will likely evaluate the siblings assets, one of which would be considered the farm.  I'm not sure if the Judge will order that the farm be sold in order to pay for any potential judgment/damages, but I suppose its a possibility, although it would be difficult since it is owned by multiple persons.  Without more information, I'm afraid I can't provide you with a more detailed answer.  But best of luck!  NOTE: This response is general in nature and should not be considered legal advice.  No attorney-client relationship exists or is formed by this response.
