QUESTION

Problems with the sale of a house between divorced couple

Asked on Mar 01st, 2014 on Litigation - New York
More details to this question:
After a long fight over a marital property and how the money is to be divided, my ex has been holding the money in his escrow account since Sept. 2013 until the court makes a decision. We have been waiting on the court since October for their decision? A week after court his Attorney was suspended by the Appellate Division for several reasons. One of the reasons was because the said Attorney dispersed funds from a transaction to his client without the knowledge of the other Attorney or the other litigant involved in a matter similar to my case. My question is: Can I demand the suspended Attorney show proof of funds and if he has the funds, direct them to a third party or give it to the court for holding? I truly believe that my ex has already received the funds and is doing all he can to stall the dispersion of these funds.

You can demand anything you want. And if the attorney is suspended the funds should be transferred to a licensed attorney's escrow account.
