Property damage to my condo caused by pipe break from unit next door

More details to this question:
I had to spend $8000 in addition to what the insurance paid to fix the unit. Liberty Mutual says that they are unable to subrogate as the unit is owned by a bank which has some clause against them going directly after the damages. They are suggesting that I file a case in the small claims court. Since the total damage is around $18000 I am unsure how to proceed forward with the claim against the bank which owns the condo that caused the damage
