QUESTION

Restraining Order On My Father ?

Asked on Jun 18th, 2013 on Civil Litigation - New Jersey
More details to this question:
I'm 18 and I graduate high school tomorrow. I have been mistreated, used and abused by my father for as long as I can remember. My mother for whatever reason will not divorce him. I'm too old for emancipation and I was wonder if there's any way to get a restraining order against him to keep him from harrassing me while I'm away at college.

Yes- you can.  Restraining orders are designed to prevent domestic violence.  You will have to be able to testify that you are in fear of harm, have been abused in the past, etc. The restraining order is available only to people who are in a domestic relationship - so you cannot file for a restraining order if you don't currently live together, or have not recently lived together. Good Luck.
