Seller being sued, $50,000.00 from buyer that did a wrap mortgage from seller 10/10/2012, Seller gave 3 extensions to buyer, buyer filed bkrcy after that buyer wanted a quit claim deed from seller or buyer wld not make pmt. Seller refused & cld not get buyer out due to bkrcy. Home is in foreclosure and wants to wrk with the bank,but needs to get buyer out first. Buyer's atty. restraining order for seller not to get in touch with buyer, so seller sent a 5 day notice to buyer's atty. Need to know what kind of case to file in court or what to do.

You need a real estate attorney. There are many gaps in your facts that would need clarifying. However, you should be able to remove this property from the bankruptcy if the paperwork (at the point of sell) was done properly.
