Should i file a civil suit?

More details to this question:
Private road contract signed notorized and file in adams county court. It was signed by all 5 bome owners and reads majority rules on all decisions of road maintenance. We had a major snowstorm January 21st 22nd and 23rd which snow accumulation was 28 plus inches. The snow removal was done by my husband and was approved by 3 homeowners it cost each homeowner $150 for the entire removal of the snow on the private road. One home owner owns to rental properties so his portion was $300 a statement was sent to him and he refuses to pay stating that he could obtain snow removal at a cheaper price. Past experience with this home owner when it comes to maintaining this private road has been never ending with excuses on what he can do and who he can get to do the jobs with no positive outcome. All homeowners were informed last year that instead of having an outside contractor come in and remove the snow that it would be done by my husband and all agreed, all parties have paid except one.

You have nothing to lose other than the filing fee with the local magistrate.  If you cannot get satisfaction by trying to work it out with your neighbor, then filing with the magistrate is a good next step.  However, if you lose, it may embolden your neighbor to not cooperate in future.
