More details to this question:
I stole a large sum of money, I am willing to pay back every dime. Can I enter into a restitution agreement with the party. And their lawyer without going to court? Can I ask that it remain a private matter and no charges are brought of paid in the agreement?

You can certainly enter into a settlement agreement without any need for involving the civil court, but any agreement to forego criminal prosecution as a consideration for settling civil claims would likely be held unenforceable. However, if the other party gets its money back it may keep it private, even though not legally obligated to do so.
