QUESTION

Sue someone for giving me an STD?

Asked on Jan 29th, 2013 on Civil Litigation - California
More details to this question:
I started dating a man who told me he had been recently tested and didn't have any STDs. After a few dates we slept together and 2 days later I had my first herpes outbreak. I had blood work done to see my body had not yet made anti bodies to the virus (meaning the virus was brand new to my body. New enough to not have created any antibodies yet.) When I told him he was unbelievablely supportive. But he insisted he had never had an outbreak and didn't know he had it. I ended up wanting to talk to other people online and find support and joined a duel discussion and dating form. One night while I was reading some messages on the form there were pictures of people interested in dating posted on the side of the screen. To my shock his photo and profile came up and he's been positive for 4 years and active on the site for a year! I was so outraged and hurt. I contacted him and told him he was scum for knowingly giving me this without a choice. Do I have a case?

Yes, you have a case for battery etc.  In the right case you can get punitive damages.  He will claim he told you, of course.  But you apparently have good proof this was your first outbreak, which helps.
