QUESTION

Suing My Association and/or board members

Asked on Mar 13th, 2015 on Civil Litigation - California
More details to this question:
A while back the board was sending out all sorts of propaganda about how we needed a guard gate because of the amount of crime that was happening in our neighborhood. Long story short we got 2, 24 hour maned guard gate. A little while after we got a email about a new security company that won the bid to replace the one we already had. Next we got the congratulatory email to the homeowners about our brand new car. The main problem with a new car was who the heck needed it or was going to drive it. That answer was quickly answered when I saw it. It had lights and the new security companies logo all over it. So this would not be so bad except for, guess who started a brand new security company and there first and only client was Greer Ranch? The answer is, drum roll, the President of the Board. So not only did the President of the Board award himself the security contract for Greer Ranch, he also used Greer Ranch funds to purchase their one and only car, not sure about the insurance.

Hi Scott, Sounds like a pretty obvious conflict of interest. Even if the contract was legitimately awarced (which doesn't appear to be the case), I can't imagine a legitmate rationale for buying a patrol car for a security company. Let me know if you want to connect to discuss options. Thanks, Jon
