QUESTION

What are my options?

Asked on Feb 07th, 2022 on Civil Litigation - Connecticut
More details to this question:
I am an FFL dealer in Illinois and I am having a dispute with a firearms manufacturer in New Britain, CT. I placed an order for merchandise with this manufacturer in early December 2021, of which has only been partially delivered. The portion of the delivered product arrived cosmetically defective. When I informed the manufacturer, I was told that I would be given a refund, only I don't want a refund, but rather my order be fulfilled free from defects. A refund would cause a loss to my profit. I have tried to explain this to the manufacturer to no avail. Now the manufacturer will not respond, and has not provided a refund or the merchandise. I want to know what I can do to be made whole. Thanks.

Depending on the amount you should be refunded, you can sue in Small Claims (up  to $5,000. in CT) or in Superior Court. If you sue in Superior Court, you can also sue for specific performance.  I would need more details but if you would like to discuss options further, my office would be happy to consult with you and look further into this matter. 203.870.6700
