QUESTION

What are the rules for Post Judgment Interest on Attorney’s Fees?

Asked on Feb 06th, 2021 on Civil Litigation - Florida
More details to this question:
In 2010, my son’s mother was awarded $21,632 for Attorney’s fees. The order stated I didn’t have to start paying but to contact her Attorney when I began to make more money. Of course, I didn’t contact her Attorney when I began to make more money. She took me back to court and was awarded in 2018 Retroactive Child Support and the Attorney’s fees from 2010 for $21632 + interest. Both to be paid monthly but start date of attorney fees are not specified bc retroactive child support must be cured first. My questions are, 1. When would interest begin to accrue, 2018 or 2010 or not until the RCS was cured? And at what rate since the law changed in Florida in 2011? 2. Can the DOR Child Support Enforcement use an IWO to collect the Attorney’s fees and refer to them as child support?

Its a fair bet the order did NOT say that, as judgments are due when they are entered. The interest will likely start runnng from the initial entry date of the judgment. If you have all these questions, its time to retain a family law lawyer to address this situation with you to make sure you are making the correct decisions.
