What can I do if a car company refuses to return my down payment?

More details to this question:
I went to a used car company in Dayton, OH. I put a down payment of $2200 on the car. I was told that I was approved and got the keys to my cars. I've had the car for three weeks and was informed that the loan was denied. He now refuses to give my down payment back and is saying he will make it into a buy here pay here contract.

You should look at the contract you signed to see what it says about the deposit. If there is nothing there, you may have a claim for CSPA violations. You should contact an attorney to obtain a free consultation so that you can discuss your situation in greater detail.

First, Ohio law would govern this transaction, not CA. Secondly, an attorney would need to see the written documentation to see what was really agreed to and whether the contract was an integrated contract such that oral promises are rendered meaningless.

You need to read your contract. If the bank denies you credit you have to return car normally, but it really depends on what you agreed to do. Take your contract docs to a lawyer and review.
