QUESTION

What can I do if my previous employer holds my final pay check?

Asked on Apr 30th, 2014 on Litigation - California
More details to this question:
I have stopped working for an employer April 25 2014, I personally quit. It is now April 30 2014 and I have not been given my final check. I read online that in California the employer has 72 hours (3 days) to give me my final check. What can I do in my case? Also I have called twice and have had no help from my previous employer.

If your employer continues to refuse to pay, your remedy is either in court or before the California Labor Commission. Because this is your final pay check, you are entitled to penalties pursuant to California Labor Code Section 203. Best of luck to you.
