QUESTION

What do I do about a return check deposit account fraud?

Asked on Sep 13th, 2012 on Litigation - Florida
More details to this question:
I just received a notice in the mail to go from the sheriff's office to get a court date and time for deposit account fraud citation and warrant. The amount of the check is 160.00 and was written in May. I didn't receive a notice but they had a returned certified letter that was unclaimed. I had no idea this check was out there. If I pay the court and merchant costs, do I still have to appear in court? What can I do to get out of court?

Yes one is a civil matter and the other is a criminal matter. You still have to go to court. get an attorney and they may be able to work out something since you paid th money back.

Hire a lawyer. Lawyers can appear for clients on misdemeanors.

If you have been notified to be in court you should be in court. If aan arrest warrant has been issued then go to the court where the warrant was issued and see to hve it put on the court's calendar to get it in front of a Judge, get the warrant recassed and deal with the charge.

No. Paying the merchant cost won't do you any good. The court case is separate, and you better hire a lawyer before you make more mistakes, like incriminate yourself by talking to the wrong people.

Without seeing what you have and the warrant, we cannot tell you. Hire an attorney in your area.
