QUESTION

What kind of lawyer do I need?

Asked on Nov 29th, 2011 on Civil Litigation - North Carolina
More details to this question:
When I was with my ex girlfriend, she purchased a car and I co-signed on the loan. In 2009 we broke up, and I moved out, leaving her the car which was in her name. Long story short, I recently received a summons from the court where I use to live and it listed both her and I as defendants. It stated that over $4,000 was due on the car plus interest since 2009. I do not know if she responded to the summons. I did not receive the summons until after the date I was to respond by. I''m not sure what to do or who to talk to. This also is coming from a state that I no longer live in. So should I find an attorney in my old state or new state?

Although I would need more information to fully answer your question, I believe your issue puts you in small claims court. Generally if you did not receive the summons until after the time to respond had expired, it is not a proper service. You may need to appear in court if you were properly served with the summons in order for the judgment not to be automatically entered against you both. Because small claims court rules vary greatly by local rules, I would recommend talking to someone in the area in which the court lies. Also I would do this as soon as possible so that no other deadlines are missed and this way this attorney can give you the proper advice on the matter. As for type of attorney, you can speak to basically any of them but I would recommend a business or civil litigation attorney.
