QUESTION

What legal rights do I have?

Asked on May 18th, 2012 on Civil Litigation - Virginia
More details to this question:
I was quoted a price of $1200 for my transmission to be rebuilt once I towed my van to the shop the damage was worst than what they thought I was told it would be an extra $500 I said ok because I was going to be on a payment plan. It has been many excuses at first it was they ordered the wrong parts then they were searching for a part then they put it together and it wasn''t working(again they had the wrong parts) in between that time I said I just wanted my van back and my parts since I was told the $950 I had paid so far only covered the parts. I paid another $300 after being told that it would be ready in two days and was also told that the rest of my fee would be waived because they took so long to repair it. That was 3 weeks ago. This week alone I have been given 3 excuse for why the job has not been completed. What can I do?

It is unclear from your question how much you paid them, and what you expect them to do.  In general, if they have failed to comply with your agreement, you can sue them in the local general district court for the damages you have sustained, and to get the court to order them to return your van to you, or give you the value of the van.  Check with a local attorney for details on what type of damages you can recover ( such as rental costs if you have rented a car ) and what type of evidence you will need to bring to court.
