When can I file a lawsuit?

More details to this question:
My employer through work force reduction has laid me off. If it is discovered through the grievance process that my former employer violated the Union Contract resulting in a wrongful dismissal Can I file suit ?. Is it possible to entertain filing suit while this matter is being litigated through the normal grievance procedure and or future arbitration?

Generally, a union contract will limit employees' ability to file a lawsuit, in favor of other procedures such arbitration and mediation.
