I was under a a settlement agreement with the finance company for my vehicle. The hail damage caused my car to be totalled thru my insurance company. When the insurance company contacted capital one they gave a different payoff amount..then emailed me a letter stating that when the vehicle was totalled it voided my agreement. When i called to ask why i wasnt advised of this when offered the settlement i was told it wasnt something that normally comes up. Since then the finance company has closed my account and charged it off as a bad debt. They have given three other amounts owed . I have all 3 in writing. As well as proof with the date the account was closed and charged off. I also still have my vehicle. The insurance company still has the check until the issue is resolved. Can you take this ?
