QUESTION

Which state to file a lawsuit against an interstate mover?

Asked on May 15th, 2013 on Litigation - Florida
More details to this question:
We moved from Virginia to Titusville, FL using a Mayflower agent. The move was horrible and many pieces of furniture were damaged in the move. We would not sign the inventory form at the move destination since we could not verify all boxes were received without a complete re-inventory and the extensive damage to our furniture (we were not given the paperwork to notate any damage until the driver wanted us to sign it). Mayflower sent a furniture refinisher/appraiser from Titusville to inspect the damage and had him fix a few pieces. One table took three attempts to refinish it correctly then the refinisher damaged the table and we were told he can't fix it. We are being offered approx. $1,400 on the furniture refinisher's estimate of furniture damage and broken non-furniture items of almost $6,000. Mayflower's claim specialist (independent contractor) has listed most items as pre-move condition even though the inventory sheet from origination does not have the same damage as our claim. A china cabinet hutch had no condition issues as evidenced by the notation of "O.k." by the driver, it now has damage and it is classified as "Pre-move condition". How do we best find an attorney with experience in moving company lawsuits? If we need to file in Virginia, do we file in the county we lived in or the county the mover's agent does business in? Thank you so much for any help. We have been dealing with this since September 2012.

You should be able to file a county court suit in your county. A consumer type attorney should do this, because there may just be some unfair and deceptive trade practices.
