QUESTION

Who can help me?

Asked on Oct 14th, 2019 on Civil Litigation - California
More details to this question:
I work in law enforcement, 5 months ago while at work a fire fighter fondled my penis. I filed a complaint with my department and with the fire department. There’s video of the incident and my partner witnessed it. Since May I have requested the man’s name and employee number. The fire department has consistently refused to provide the information. So I proceeded with a crime report without the information. I’m seeking to sue for emotional distress and punitive damages. If they’re refusing to give up their employee am I able to sue the fire department for his actions?

Dear William, at this point you may want to speak with an employment attorney in regard to the fire department that you work for. Typically, you would be able to obtain this information through a subpoena with a court order once in litigation.
